Terms And conditions
of Business

The following terms shall apply to all trading between Enlighten Smiles Limited ("the Company") and the customer ("the purchaser").
Prices are subject to alteration without previous notice. Goods and services will be charged at the price list ruling at the date of dispatch.
The prices quoted are exclusive of VAT which will be charged at the current applicable rate at the time of dispatch.


Payment for the Company's goods and services on credit shall be made 30 days from invoice date unless other agreements are in place. A late payment fee may be charged on accounts which remain unpaid 30 days after due date . NOTE: A pre-payment will apply to all new customers on their first order. All orders placed on line shall be paid for at the time of ordering. Carriage, packaging and insurance charges may be invoiced. The purchaser shall be responsible for ensuring the presence at the premises nominated for delivery of a person authorised to receive and sign for goods.
The risk in the goods will pass to the purchaser upon delivery thereof to the premises nominated by the purchaser unless the purchaser shall notify the Company within two days of delivery of any loss, damage, shortage or error relating to the goods received. Such notification to be made on the prescribed form which is enclosed with all deliveries. If the purchaser shall fail to make such notification, the Company shall be under no obligation to take return of the goods and raise a credit, nor to refund carriage charges, and the purchaser shall remain liable to pay for the goods.


Goods shall remain the property of the Company until the whole of the contract price has been paid, but after delivery, the purchaser shall be responsible for and shall indemnify the Company against all loss of or damage to the goods from whatsoever cause occurring, at any time until the Goods have been paid for and without prejudice to any other remedies, the Company or its agents shall be entitled immediately after giving notice of its intention to do so, enter upon the premises of the purchaser with such transport as may be necessary and re-possess any Goods to which the Company has title hereunder.


If the purchaser shall make any default in paying any sum to the Company as and when it becomes due or if he shall have distress of execution levied on any of his goods or property or if he shall make or offer to make any arrangement or composition with creditors or if he shall commit any act of bankruptcy or have a petition presented against him, or if, being a limited company, resolution or petition to wind up the purchaser (other than for the purpose of reconstruction or amalgamation without insolvency), shall be passed or presented or if a receiver shall be appointed over the whole or any part of the purchaser's business, all sums owing by the purchaser to the Company become immediately due and payable (plus service charge thereon) and the Company shall have the right forthwith to withhold all further deliveries of goods or to determine any contract then subsisting between the Company and the purchaser. Such determination shall give rise to no liability whatsoever on the Company part but shall be without prejudice to the Company's right to payment in respect of manufacturing or other work already carried out or goods already delivered.


Except as provided in this clause goods are supplied with the benefit of all conditions and warranties which are implied by statute from time to time provided that the Company shall not be liable for any consequential damages or expenses or any liability to third parties incurred by the purchaser and shall be under no liability whatsoever to the purchaser in respect of any goods sold as "imperfect" or under any similar description. Nothing in the aforesaid proviso shall apply to the terms implied by Section 12 of the Sale of Goods Act 1983 (as amended).


If the goods are not used or serviced in accordance with manufacturer's instructions, then the guarantee is null and void. Normal wear and tear on parts will not be covered by the guarantee.


The purchaser shall not be entitled to withhold payment of any sums after they have become due by reason of any right of set off or counter claim which the purchaser may have alleged or for any reason whatsoever.


The Company will not accept the return of any goods to it unless such return has been approved and is accompanied with the original invoice or packing note. Dated products licensed under the Medicines Control Act cannot be taken back into stock after expiration date or if the packaging is opened or incomplete. Purchase of any event tickets are non-refundable and non-transferable.


Goods which are specially ordered by the Company for a customer are not returnable.


These terms and conditions and the contract in which they are incorporated shall be governed by English Law.


The placing of an order implies acceptance of all the Company terms.
In the case of Exportation of Goods, terms for delivery and payment shall be arranged with the purchaser.

How we will use the information we collect about our Professionals:

  • When you make a purchase through our website we automatically provide some of your information to a courier company to secure the delivery of the product and to the companies who process the payment on our behalf; either World Pay or Stripe.   • We share your information with selected third party service providers who perform functions on our behalf such as laboratory work, website hosting, analytics and search engine providers that assist us in the improvement and optimisation of our site.
  • We do not authorise these third parties to use your information for purposes other than for which it has been provided, and do not authorise these third parties to disclose that information to unauthorised parties. We require these third parties to maintain appropriate security to protect your information from unauthorised access or processing.


How we keep your information secure:

  • All the information that we obtain from you is stored securely within the EU on a cloud business management software called Oracle Netsuite. We also use a commerce e-marketing platform called Oracle Bronto which stores our customers’ data in the US. We have ensured that Oracle have the appropriate security measures in place to keep your data safe.
  • When your credit or debit card account information is being transmitted to our website it will be protected by cryptographic protocols. Enlighten Smiles does not store your complete credit or debit card account information, but a redacted record of the card number and expiry date of the card used. We do not have direct control over or responsibility for your credit or debit card account information. We use third party payment processors that are the controllers of your credit card information. Our contracts with third parties that receive your credit or debit card account information require them to keep it secure and confidential.
  • We would like to communicate with you via email and text message. We will use the email address that you have provided to us in order to send you information about our services and to respond to you when you have an enquiry, raise a concern or complaint with us regarding either our products or service, or the service of any of Enlighten Smile accredited dentist. We are not able to guarantee the security of any email servers, such as outlook, gmail or yahoo.
  • The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

We deliver our products either using Royal Mail (up to 3 working days in the UK) or UPS (1-2 business days in the UK and 3-5 business days outside the UK), between 9am-5pm Monday to Friday.

Delivery costs vary according to weight of the shipment and also destination country. In the UK delivery charges for lower value items are shipped using Royal Mail and cost £4.00. For higher value items we ship by UPS and the charges are £5.25 plus VAT for the smallest shipments and increase according to the weight. Exact delivery costs are quoted on check out.

If you have a specific request regarding the delivery of your order, please e-mail orders@enlightensmiles.com and don't forget to quote your Order Number.

Please note that we endeavour to dispatch all orders within 24 hours upon confirmation of payment, with the exception of sale and special promotion periods/items where this may take longer. Estimated delivery times are a guide only, and commence from the time of dispatch. Please note that ENLIGHTEN SMILES LIMITED is not responsible for any delays caused by customs clearance processes at the shipping destination.

Important Information

Orders cannot be re-directed once they have been dispatched. Order cut-off times are provided as a guideline only, and do not take into account delays caused by payment authorisation.

Insurance

All items shipped are insured by ENLIGHTEN SMILES LIMITED during the time that the order is in transit until it is delivered to the nominated delivery address. In using us you accept that an order is considered delivered when it has been signed for at the delivery address.

Taxes & Duties

Value Added Tax (VAT) is calculated and included in all orders to UK and EU shipping destinations. All orders shipped internationally are exclusive of GST.

Taxes & Duties - International Shipments

Please note that order pricing is exclusive of all international duties and taxes. As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to - payment of these is necessary to release your order from customs on arrivals. As we are unable to advise the amount this may be, by using this website you accept responsibility for any such taxes and duties.

Additionally, when ordering from ENLIGHTEN SMILES LIMITED, you are the importer and must comply with all laws and regulations of the destination country. You authorise us to designate a carrier to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise and advance (on your behalf) any taxes and duties owed by you.

Under no circumstances will ENLIGHTEN SMILES LIMITED refund or reimburse duties and taxes levied by the destination country. Should you reject your order at customs and your order is returned to us, your order refund will be the total order amount less shipping costs and any taxes and duties paid by ENLIGHTEN SMILES LIMITED on your behalf.
